These Terms of Use ("Terms") govern your access to and use of the Diet.AI website and application ("Diet.AI", the "Service"), operated by Infowallet LLC, 412 W 7th St STE 1233, Clovis, NM 88101, United States ("Infowallet", "we", "us"). By purchasing, downloading, or using Diet.AI you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase or use Diet.AI. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
Diet.AI is a nutrition tracking tool that lets you log meals, search a food database, and analyze food photos to estimate nutritional values. Diet.AI is provided for informational and personal-organization purposes only.
Diet.AI does not provide medical, nutritional, diagnostic, or treatment advice. Nutritional estimates — including those produced by photo analysis — are approximations and may be inaccurate. Always consult a qualified physician, registered dietitian, or other healthcare professional before making decisions about your diet, health, medication, or medical conditions. Never disregard professional medical advice because of information shown in Diet.AI.
Diet.AI is offered as a one-time purchase that grants you a personal, non-exclusive, non-transferable, revocable license to use the application. Your license rights are described in the End User License Agreement (EULA). Refunds are governed by the Refund Policy.
You agree not to:
You retain ownership of the meals, photos, notes, and other content you submit to Diet.AI. You grant Infowallet a limited license to host, process, and display that content solely to operate and support the Service for you. You are responsible for ensuring you have the right to submit any content you upload.
Diet.AI, including its software, design, trademarks, and content (excluding your content), is owned by Infowallet LLC and protected by intellectual property laws. No rights are granted other than the limited license expressly described in these Terms and the EULA.
We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. We may also update these Terms; material changes will be reflected by a new effective date on this page, and continued use of the Service constitutes acceptance.
The Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, Infowallet LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or health outcomes arising from your use of the Service. Our total aggregate liability relating to the Service will not exceed the amount you paid for Diet.AI.
We may suspend or terminate your access if you breach these Terms or use the Service unlawfully. You may stop using the Service at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict-of-law rules. Disputes will be brought before the competent courts located in New Mexico, unless mandatory local law grants you the right to another forum.
