This End User License Agreement ("Agreement") is a legal agreement between you and Infowallet LLC, 412 W 7th St STE 1233, Clovis, NM 88101, United States for the Diet.AI software, including all updates and documentation ("Software"). By installing or using the Software you accept this Agreement.
Subject to your compliance with this Agreement and payment of the applicable one-time fee, Infowallet grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Software for your own personal, non-commercial use.
The Software is licensed, not sold. Infowallet LLC and its licensors retain all right, title, and interest in and to the Software, including all copyrights, trademarks, and other intellectual property rights.
You may not:
Infowallet may provide updates, bug fixes, or improvements to the Software. Such updates are covered by this Agreement unless they are accompanied by separate terms. Some features may depend on internet connectivity or third-party services.
The Software may rely on third-party components and services, including AI processing providers and app stores. Your use of those services may be subject to their own terms. Infowallet is not responsible for third-party services.
The Software is not a medical device and must not be used to diagnose, treat, cure, or prevent any disease. Nutritional values are estimates and may be inaccurate. Consult a healthcare professional for medical or dietary decisions.
This Agreement is effective until terminated. It terminates automatically if you breach any of its terms. Upon termination you must stop using and delete all copies of the Software. Sections 2, 3, 6, 8, 9, and 10 survive termination.
The Software is provided "as is" without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement, to the maximum extent permitted by law.
To the maximum extent permitted by law, Infowallet LLC will not be liable for any indirect, incidental, special, or consequential damages, or loss of data or profits, arising from the use of or inability to use the Software. Total liability is limited to the amount you paid for the license.
